0. Summary & Effective Dates

These Terms of Use (“Terms”) apply to GoRealo’s websites and mobile apps (iOS & Android). These Terms supplement any applicable end user license agreement (e.g., Apple's standard EULA for iOS apps). By using our Services, you agree to these Terms. If you do not agree, please do not use the Services. You also agree to our Privacy Policy, incorporated herein by reference.

1. Acceptance of Terms

By accessing and using GoRealo’s website, mobile applications, and services (collectively, the “Services”), you accept and agree to be bound by these Terms. If you do not agree, please discontinue use.

GoRealo is a DBA of Consumer Credit Services, LLC (“GoRealo,” “we,” “us,” or “our”). These Terms constitute a legally binding agreement between you and Consumer Credit Services, LLC and supersede any prior agreements related to the Services.

1.5. Legal Compliance

You and GoRealo agree to comply with all applicable laws and regulations worldwide, including but not limited to privacy laws (e.g., GDPR, CCPA), financial regulations, export controls, sanctions, and anti-discrimination rules. For regulated activities like mortgage loans, Services are available only in jurisdictions where GoRealo is properly licensed. GoRealo does not facilitate illegal activities, and violations may result in immediate termination.

2. Description of Services

GoRealo provides technology and mortgage related tools designed to streamline the lending process and empower real estate partners, including:

• Online mortgage pre qualification, pre approval, and applications
• Loan origination support and processing workflows
• Daily rate display, rate comparison, and loan program information
• Document collection, verification, and secure messaging
• Real time loan status updates
• Realtor partnership/referral tools and listing related utilities
• Mobile applications for managing the above functions

Licensing: Mortgage loans are originated only in states where GoRealo (Consumer Credit Services, LLC) is properly licensed. Services are geo-restricted to such licensed jurisdictions; if you request a loan in an unlicensed state, we may, with your explicit written consent (in addition to any verbal authorization), connect or sell your lead to a licensed lender in your state. GoRealo discloses all relevant licensing information upon request.

3. Eligibility & Registration

Eligibility

• Be at least 18 years of age (to comply with applicable laws, including children's privacy protections like COPPA)
• Use the Services for lawful purposes only
• Have capacity to enter a binding agreement
• Not access the Services for competitive intelligence, scraping, or reverse engineering

Account Registration

• Provide true, accurate, current, and complete information. We minimize data collection to what is necessary for core functionality.
• Maintain and promptly update your information
• Keep your credentials confidential; you are responsible for all activity under your account
• Notify us immediately of any unauthorized access
• You may delete your account at any time via in-app settings or by contacting us at legal@gorealo.com. Upon deletion, we will remove your personal data in accordance with our Privacy Policy, except where retention is required by law.

4. Loan Process, Rates & Rate Locks

Application

• By submitting an application, you authorize credit pulls and verification of information
• You consent to electronic delivery of disclosures and documents
• Pre approval is not a guarantee of final approval

Rates & Locks

• Rates displayed may change at any time without notice
• Selecting a rate does not initiate a lock
• A valid lock requires your verbal authorization and confirmation with a licensed mortgage professional
• Until locked, all rates and terms remain subject to market changes

5. Real Estate Agent Use & Data Handling

• Agents must comply with local MLS rules and policies
• Post only listings you represent or have written authorization to publish
• You are responsible for rights to any data (images, MLS data, reviews) you submit
• You agree to indemnify and hold GoRealo harmless for claims arising from your listings, MLS compliance, or data usage

Borrower Status Sharing with Referring Agent

If a borrower was referred by an agent, the borrower consents to limited status updates to that agent (e.g., application received, pre approval/approval status, anticipated closing date). We will not share financial details (e.g., credit score, income, account numbers) unless the borrower provides explicit written consent. Borrowers can revoke consent at any time via the contact methods below or in-app settings; revocation will be processed within 30 days.

6. User Responsibilities & Prohibited Activities

Prohibited Activities

• Providing false, misleading, or fraudulent information
• Illegal or unauthorized use; attempting to bypass security controls
• Reverse engineering, decompiling, or disassembling the Services
• Using robots, spiders, scrapers, or other automated means without written consent
• Accessing the Services for competitive analysis or product development
• Infringing third-party intellectual property rights, including copyrights, trademarks, or patents
• Engaging in deceptive practices, such as tricking users into unwanted data sharing or purchases, or child sexual abuse or exploitation

Information Accuracy

Providing false or incomplete information may result in denial of services, account suspension, legal action, and/or reporting to authorities.

7. User Generated Content & Intellectual Property

You are solely responsible for content you submit. We do not verify or guarantee the accuracy of user submissions. You agree to indemnify GoRealo against claims arising from your content.

All content, features, and materials in the Services are owned by GoRealo or our licensors and protected by intellectual property laws. You receive a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial purposes. You must not copy, distribute, modify, or create derivative works from the Services without permission.

You retain ownership of content you submit but grant GoRealo a worldwide, royalty-free, perpetual license to host, use, and display it as needed to provide the Services. You represent that your submissions do not infringe any third-party rights. GoRealo reserves the right to remove infringing content.

8. Privacy & Communications

Your use of the Services is also governed by our Privacy Policy, located at https://gorealo.com/privacy, which is incorporated into these Terms by reference and must be easily accessible in the app (e.g., via settings menu).

We collect only necessary personal data (e.g., contact information, loan application details, usage data) to provide the Services, process it securely, and minimize retention to what is required for functionality or legal obligations. Data is used for purposes like loan matching, communications, and service improvement, and shared only with your consent (e.g., with referring agents or licensed lenders). Third parties must provide data protections at least as strong as ours. You can revoke consent, request deletion, or access your data at any time via in-app tools or by contacting us—requests are processed within 30 days, except where law requires retention. By using the Services, you consent to receiving communications (phone, text, email, and in app), subject to applicable law (e.g., TCPA). You may opt out at any time as described in the Privacy Policy or via reply/unsubscribe mechanisms.

9. Third Party Links & Services

Our Services may contain links to third party sites or services. We are not responsible for their content, policies, or practices. Any data shared with third parties (e.g., licensed lenders) requires your explicit consent and is protected equivalently to our practices.

10. Disclaimers & Service Availability

• Services are provided “as is” and “as available”
• No warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, or non infringement)
• We do not guarantee uninterrupted or error free operation; maintenance may limit access
• We may modify, suspend, or discontinue any part of the Services

11. Limitation of Liability

To the fullest extent permitted by law, GoRealo shall not be liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, data, or business), business interruption, or the cost of substitute services. Where permitted, our aggregate liability is limited to the fees you paid to GoRealo in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless GoRealo, its officers, directors, employees, and agents from claims, losses, and expenses arising out of your use of the Services, violation of these Terms, violation of third party rights, or provision of false/misleading information.

13. Right to Suspend/Remove & Force Majeure

We may remove content, suspend accounts, or block access for any reason, including suspected violations, fraud, or non compliance. We respond to support inquiries within 3 business days. We are not liable for delays or failures caused by events beyond our reasonable control (including natural disasters, governmental actions, labor disputes, and internet outages).

14. Governing Law, Arbitration & Class Action Waiver

• Governing Law: State of Florida (without regard to conflict of law rules)
• Venue & Arbitration: Binding arbitration in Duval County, Florida under the rules of the American Arbitration Association. Notwithstanding the foregoing, either party may seek injunctive relief in court for IP infringement or to enforce arbitration.
• Waivers: Jury trial and class/collective/representative actions are waived; claims must be brought individually
• Attorney’s Fees: The prevailing party is entitled to reasonable attorney’s fees and costs

15. Changes to Terms

We may update these Terms at any time. Material changes will be notified via email (to your registered address), in-app notification, or prominent posting on our site. Your continued use after such notice constitutes acceptance.
